Terms and Conditions Basecamp Eco-resorts

If you make a reservation at one of our Basecamp Eco-resorts via our website, email, telephone, or by any other means, these conditions apply.

  1. APPLICATION

1.1 These General Terms and Conditions apply to all offers, reservations, and agreements concerning all accommodations and other facilities and services rented or provided by Basecamp Eco-resorts BV, its group companies, or affiliated companies (hereinafter referred to as ‘Basecamp Eco-resorts’).

1.2 In these General Terms and Conditions, the term ‘tenant’ refers to: the person who enters into an agreement with Basecamp Eco-resorts regarding the rental/use of accommodation, facilities, and/or services. The term ‘user’ (also referred to as ‘guest’ below) refers to: the tenant and the persons specified by the tenant in advance who will use the accommodation, other facilities, and/or services rented by the tenant.

1.3 These General Terms and Conditions apply regardless of your (prior) reference to any own terms or other general conditions. Basecamp Eco-resorts rejects all terms and conditions referred to by you or used by you.

1.4 Agreements deviating from these General Terms and Conditions are only valid if agreed upon in writing.

  1. RESERVATIONS

2.1 Basecamp Eco-resorts only accepts reservations from persons who are 18 years of age or older. Reservations by persons younger than that age are therefore not legally valid.

2.2 Basecamp Eco-resorts reserves the right to reject deviant reservations, for example, from young people or groups, without giving reasons, or to attach special conditions to them.

2.3 If Basecamp Eco-resorts accepts your reservation, Basecamp Eco-resorts will send you a reservation confirmation along with an invoice within 24 hours after the reservation is made. You must check this immediately upon receipt for accuracy. Any inaccuracies must be immediately communicated to Basecamp Eco-resorts.

2.4 If you do not receive a reservation confirmation/invoice within 24 hours after making the reservation, you must contact the reservation department immediately, failing which no claim can be made on the reservation.

2.5 An agreement between you and Basecamp Eco-resorts is concluded when Basecamp Eco-resorts confirms the reservation to you.

2.6 The agreement concerns the rental of accommodations and/or other facilities for recreational use of a short-term nature. The agreement may also concern the rental of accommodation and/or other facilities, possibly in combination with certain services provided by Basecamp Eco-resorts, for business use of a short-term nature, for example, for holding a business event.

2.7 The rental and/or right to use accommodation and/or other facilities expires automatically without any notification as soon as the period for rental and/or use agreed upon in the confirmation ends.

  1. CHANGES TO THE AGREEMENT

3.1 If you wish to make changes to the agreement after its conclusion, Basecamp Eco-resorts is not obliged to accept them. It is at the discretion of Basecamp Eco-resorts to determine whether and to what extent these changes are accepted. In case Basecamp Eco-resorts accepts your changes, Basecamp Eco-resorts will charge you change fees. Cancellations are subject to the cancellation conditions as described in Article 14 of these General Terms and Conditions.

  1. SUBSTITUTION

4.1 The tenant and other users are not allowed to assign the accommodation, under any name or for any reason, to persons other than those mentioned in the agreement, unless otherwise agreed in writing with Basecamp Eco-resorts.

4.2 If you and Basecamp Eco-resorts have agreed that you and/or one or more users are replaced, you will remain jointly and severally liable to Basecamp Eco-resorts alongside the tenant and/or user(s) replacing you and/or other users for the payment of the outstanding part of the rental price, change fees (see art. 3.1), any additional costs resulting from the replacement, damages, and any cancellation costs.

  1. PRICES

5.1 You are liable to Basecamp Eco-resorts for the agreed rental price, as stated in the reservation confirmation along with the invoice. To avoid misunderstandings: the ‘rental price’ may also include costs for services provided by Basecamp Eco-resorts.

5.2 Price discounts and/or special offers cannot be used once the reservation confirmation/invoice has been sent by Basecamp Eco-resorts.

5.3 All prices are, where applicable, inclusive of VAT unless otherwise stated.

5.4 Basecamp Eco-resorts has the right to implement and adjust price increases resulting from interim adjustments to essential regulations or provisions (including, but not limited to VAT, tourist tax, and insurance tax) over which Basecamp Eco-resorts has no decisive influence, and to settle them.

5.5 The tenant is not entitled to offset any claim against Basecamp Eco-resorts with claims that Basecamp Eco-resorts has against the tenant or to suspend any payment obligation.

  1. PAYMENTS

7.1 Upon reservation, you have the option to make payment of the rental fee directly via iDeal or provide your credit card details. If you choose to finalize the reservation with a credit card, the credit card will not be charged until 3 days before arrival.

7.2 If upon arrival at the park, it appears that the rental fee amount has not yet been fully credited to Basecamp Eco-resorts’ bank account, you must (or any remaining part of it) pay the rental fee on the spot. In the absence of payment as described above, Basecamp Eco-resorts may deny you the use of the accommodation and/or other facilities. If it later transpires that a valid payment instruction was given by you, but the amount is credited to Basecamp Eco-resorts’ bank account after arrival, any overpayment will be refunded afterward.

7.3 In case of non-timely payment of the invoiced amounts, you will be in default immediately after the expiration of the payment term mentioned in the invoice. In that case, Basecamp Eco-resorts may offer you the opportunity to pay the outstanding amount within 7 days, failing which you will be immediately in default. If payment is not made, Basecamp Eco-resorts reserves the right to terminate (cancel) the agreement from the day the default occurs, and you are liable for all damages that Basecamp Eco-resorts suffers or will suffer as a result, including all costs that Basecamp Eco-resorts has had to incur in connection with your reservation and the termination, including losses suffered by Basecamp Eco-resorts. Basecamp Eco-resorts has the right to charge cancellation costs per accommodation in any case. In that case, the provisions of Article 14 apply.

7.4 Basecamp Eco-resorts always has the right to offset any claims against you for any reason with amounts paid by you for any reason or with amounts that Basecamp Eco-resorts may owe you.

  1. ARRIVAL AND DEPARTURE

8.1 The rented accommodation can be occupied from 3:00 PM on the agreed day of arrival as stated on the reservation confirmation. On the agreed day of departure, as stated on the reservation confirmation, the accommodation must be vacated by 10:00 AM.

8.2 If you wish to extend the agreement with Basecamp Eco-resorts for longer than the agreed duration and Basecamp Eco-resorts agrees to this in writing, Basecamp Eco-resorts always has the right to assign another accommodation.

8.3 If the use of the accommodation and/or other facility is terminated earlier than on the agreed date as stated on the reservation confirmation, the tenant is not entitled to a refund of (part of) the rental fee and/or costs by Basecamp Eco-resorts. If you have taken out cancellation insurance and you meet the conditions set by the insurance company, you can submit a damage claim for early termination of your stay directly to the insurance company.

  1. RULES AND REGULATIONS

9.1 All guests must adhere to the rules established by Basecamp Eco-resorts for the parks, documented in, among others, the Park Regulations. Park regulations may vary from park to park and are usually available on the website of the respective park. You can also request the relevant Park Regulations upon arrival at the reception. It is strictly prohibited for tenants and users on all parks to act in violation of the law and/or public order and/or good morals. This includes, but is not limited to, drug use and causing noise disturbances.

9.2 According to local regulations, every guest is required to provide identification during check-in (online or in person). If a guest cannot present identification, Basecamp Eco-resorts may decide to deny the guest access to the accommodation and the park.

9.3 Each accommodation may only be used by the maximum number of persons specified in the brochure and on our website for the respective accommodation.

9.4 Basecamp Eco-resorts reserves the right to make changes to the layout and opening hours of the park facilities. For necessary maintenance, you will allow work to be carried out on the accommodation or other facilities during your stay without entitlement to compensation.

9.5 For safety reasons, it is not permitted to pitch tents at the accommodation.

9.6 The tenant must leave the accommodation broom clean (i.e., no dirty dishes left, bedding removed and folded, kitchen and refrigerator cleaned, garbage bags placed in the designated container).

9.7 In case of violation of the rules included in these General Terms and Conditions, the Park Regulations, or failure to follow staff instructions, Basecamp Eco-resorts has the right to immediately remove you, the tenant, and any other user from the park, without any refund of the rental fee or any part thereof.

9.8 If park management suspects that a tenant or user of an accommodation is acting in violation of the law and/or public order and/or good morals, park management is authorized to access the accommodation. Article 9.7 of these General Terms and Conditions applies in that case.

  1. PETS

10.1 Depending on the accommodation, Basecamp Eco-resorts may allow a maximum of one dog belonging to the tenant or users. If you and/or a user wish to bring a dog, you must indicate this directly upon reservation. In that case, Basecamp Eco-resorts will charge a surcharge, which must be paid by you. Other pets are not allowed. Basecamp Eco-resorts reserves the right to refuse pets on the park (without giving reasons) or deny them access to the park if they cause disturbances.

10.2 Dogs are not allowed access to water features, restaurants, covered center facilities, and other public areas in the park (unless indicated otherwise on-site). Dogs must be leashed outside the accommodation. On-site instructions must be followed. Dogs must not disturb other guests.

10.3 A dog bed must be brought along, and protection against fleas is mandatory; drops, pills, or collars are sufficient.

10.4 Dogs and other pets of visitors are not allowed.

10.5 For transporting animals to countries within the EU, they must have a passport according to the European model (from July 3, 2004). The animals must be vaccinated against rabies, and identification by means of a chip or tattoo is mandatory. You are responsible for having the correct travel documents required for your destination.

  1. USE OF ACCOMMODATION; INVENTORY

11.1 The tenant, users, and those accompanying the tenant are jointly liable for orderly conduct in and around the rented accommodation and elsewhere in the park, use of the accommodation and facilities, and the equipment therein.

11.2 Additionally, the tenant, user, and those accompanying the tenant are jointly liable for damages due to breakage and/or loss and/or damage to inventory and/or accommodation. Any damage must be immediately reported to Basecamp Eco-resorts by the tenant and immediately reimbursed on-site, unless the tenant can prove that the damage is not attributable to fault on their part, other users, or any member of their party.

  1. INTERNET USAGE

12.1 Depending on the accommodation, Basecamp Eco-resorts provides the tenant, users, and those accompanying the tenant access to the internet via a WiFi network or via cable.

12.2 The tenant is responsible for the correct use of the internet as well as the necessary hardware and software, configuration, peripherals, and connections to support it, and measures to secure the computer and/or operating system.

12.3 Basecamp Eco-resorts is not liable for damages resulting from the use of the internet or due to network disruptions.

12.4 The tenant, users, and those accompanying the tenant must behave when using the internet as expected of a responsible and careful internet user and respect the essential rules. The tenant and users will refrain from using the internet in a way that inconveniences other internet users or causes damage to Basecamp Eco-resorts in the broadest sense. The tenant, users, and those accompanying the tenant will refrain from visiting internet websites that have an unlawful character and/or do not align with the reputation of Basecamp Eco-resorts.

12.5 Upon observation or suspicion of interference by third parties and/or (other) internet misuse by the tenant, users, or those accompanying the tenant, Basecamp Eco-resorts has the right, without further notice, to block access to the internet either partially or entirely.

12.6 The tenant indemnifies Basecamp Eco-resorts against claims from third parties for compensation for damages that these third parties may (try to) claim from Basecamp Eco-resorts in any way, to the extent that this liability is based on the internet usage by the tenant, users, or those accompanying the tenant.

  1. DEPOSIT

13.1 Basecamp Eco-resorts may require a deposit from you prior to or at the start of the stay. The deposit is usually €100 per accommodation but may be increased by Basecamp Eco-resorts if circumstances warrant it (e.g., groups).

13.2 The deposit serves as security for damages and/or costs – in the broadest sense of the word – that Basecamp Eco-resorts may incur due to non-compliance with obligations by the tenant, user, and/or those accompanying the tenant.

13.3 If the deposit is not paid immediately when due, Basecamp Eco-resorts is entitled to deny the tenant and/or other users access to and use of the accommodation and facilities.

13.4 If you fail to pay the deposit, Basecamp Eco-resorts is also entitled to terminate (cancel) the agreement with immediate effect, in which case the provisions of Article 14 apply.

13.5 The deposit or any remaining amount thereof will be refunded after offsetting against claims of Basecamp Eco-resorts against the tenant and/or users (for example, due to damage to inventory/accommodation and/or other costs). Offsetting of the deposit does not affect Basecamp Eco-resorts’ right to any (further) claims for damages.

  1. CANCELLATION COSTS

14.1 If a reservation is canceled, cancellation fees are due. The cancellation fees depend on the type of booking:

– For Flexible Rate: cancellation without charge is possible up to 2 days (48 hours) before the scheduled arrival. For later cancellations, 100% of the rental price will be charged.

– For Non-Refundable Rate: in this case, 100% of the total rental price is always due upon cancellation.

Cancellations must always be communicated in writing to Basecamp Eco-resorts.

14.2 You can insure yourself against cancellation risks by taking out a cancellation insurance simultaneously with your reservation.

14.3 If you have not arrived at the park within 24 hours of the arrival date stated in the confirmation, this will be considered a cancellation unless you have notified Basecamp Eco-resorts in advance that you and your party would arrive later.

14.5 If, after the conclusion of an agreement for the rental of more than one accommodation, you wish to reduce the number of accommodations, it will be considered a cancellation, and 100% of the rental price will always be due, unless explicitly stated otherwise in the relevant agreement.

  1. FORCE MAJEURE AND AMENDMENT

15.1 If Basecamp Eco-resorts is unable to perform the agreement in whole or in part due to force majeure, Basecamp Eco-resorts may, within 14 days after becoming aware of the impossibility of performing the agreement, propose a change to you (for different accommodation/other period, etc.).

15.2 Force majeure on the part of Basecamp Eco-resorts exists if the performance of the agreement, in whole or in part, is (partly) prevented, whether or not clearly recognizable to you, by circumstances beyond the will or control of Basecamp Eco-resorts, including but not limited to the risk of war, labor strikes, blockades, fire, floods, and other disruptions or events.

  1. TERMINATION

16.1 Basecamp Eco-resorts has the right to terminate the agreement immediately at all times if incomplete and/or incorrect personal data of you and/or other users are provided at the time of booking. In such a case, no refund of the rental price or any part thereof will be made.

  1. LIABILITY

17.1 Basecamp Eco-resorts is not liable for theft (including theft from safes or lockers), loss, or damage to property or persons of any kind during or as a result of a stay at one of our parks and/or the rental and use of accommodation and/or other facilities of Basecamp Eco-resorts, unless there is intent or gross negligence on the part of Basecamp Eco-resorts or its employees.

17.2 Basecamp Eco-resorts is not liable for disruptions in services or defects in services provided by third parties.

17.3 You are jointly and severally liable with the user for all loss and/or damage to the rented accommodation, facilities, and/or other properties of Basecamp Eco-resorts arising during their use by you and/or other users, whether or not as a result of your own actions or omissions and/or those of third parties present on the park with your permission.

17.4 You indemnify Basecamp Eco-resorts against all claims for damages from third parties resulting from any act or omission by yourself, other users, your travel companions, or third parties present on the park with your permission.

17.5 In case of improper use or improper leaving, including but not limited to excessive pollution, of the accommodation, additional costs will be charged, which you are then obliged to pay immediately.

  1. COMPLAINTS

18.1 Despite the care and effort of Basecamp Eco-resorts, you may believe you have a justified complaint regarding your holiday stay. This complaint should first be reported on-site and directly to the management of the park where you are staying. If the complaint is not handled to your satisfaction, you have until 1 month after departing from the park of your stay to submit your complaint in writing to:

Please include your reservation number, contact details, date of stay, park name, and accommodation number. Your complaint will then be handled with the utmost care. We will respond to your complaint within 3 working days.

If this does not lead to a satisfactory solution, you can also submit your complaint to the Disputes Committee via the European ODR Platform (https://ec.europa.eu/consumers/odr/). The decision of this committee is binding. You can also submit your complaint to the competent court in Amsterdam as prescribed by law.

  1. APPLICABLE LAW

19.1 Dutch law exclusively applies to the agreement between you and Basecamp Eco-resorts, as well as to all related claims and disputes.

19.2 The competent court in Amsterdam has jurisdiction over all disputes arising from or related to the agreement between you and Basecamp Eco-resorts.

  1. TRAVEL DOCUMENTS

20.1 You are responsible for ensuring you have the valid travel documents required for your destination. Basecamp Eco-resorts is not liable for the consequences resulting from not having the correct travel documents.

  1. PRIVACY

21.1 To make a reservation for one of our accommodations, we require personal data from you. We understand that you would like to know what data we need, why we ask for this data, who will see your data, and how long we will retain this data. In our privacy policy, we provide answers to all these questions and more. The privacy policy can be found at www.basecamp-ecoresorts.com.

  1. GENERAL

22.1 Basecamp Eco-resorts will send its correspondence digitally, unless this proves not feasible.

22.2 Obvious printing and typographical errors do not bind Basecamp Eco-resorts.

22.3 These General Terms and Conditions supersede all previous publications.

22.4 These General Terms and Conditions are available in multiple languages on the Basecamp Eco-resorts website. In case of any discrepancies, the Dutch text of the general terms and conditions shall prevail.
